Article 1 - Definitions of terms used

In these Terms, the following shall be understood as:

1. Customer: a person who has entered into an agreement with Proxynode.
2. Service(s): the provision of the products we rent, accessible via the Website.
3. Website: the online webpage accessible via https://proxynode.pro/
4. Account: the access rights where the Customer can manage and configure (certain aspects of) the Services
5. Credit: credit on our Website is an internal currency and payment method allowing users to obtain and utilize virtual units for various Services, subject to the Proxynode’s General
6. Agreement: any agreement between Proxynode and the Customer whereby Proxynode provides services to the Customer.
7. Terms or Conditions: you can find these General Terms and Conditions on our Website.
8. Illegal activities: any act, practice, behavior, or activity that violates applicable Dutch and European Union laws and regulations, including but not limited to crimes, offenses, infringements of intellectual property rights, fraud, money laundering, and any other activity deemed unlawful according to applicable laws and regulations.

Article 2 - Applicability

1. These Terms apply to all quotations, offers, orders, products, and services offered by Proxynode.
2. The Terms are accessible to everyone via the Proxynode Website.

Article 3 - Obligations

1. Proxynode guarantees that the provided Service(s) meet the Agreement and all specifications as stated in the offer.
2. Proxynode may not make any changes to the provided service(s) without the Customer's consent.
3. Proxynode is obliged to deliver and maintain the Service(s) ordered by the Customer to the best of its ability, within the limits of what is possible.

Article 4 - Payments

1. Proxynode sends an invoice to the Customer, who has ample time to pay the invoice.
2. With regard to clause 1, if the Customer fails to make the payment, Proxynode has the right to suspend the Service(s).
3. By agreeing hereto, you authorize Proxynode to engage a debt collection agency with the aim of collecting the outstanding amount.
4. When making a payment for a service or settling an invoice, the full amount, including VAT and any setup fees, will be charged unless otherwise indicated.

Article 5 - Right of withdrawal and compensation

1. You agree that your right of withdrawal lapses once you have received the service.
2. You agree that refunds may be processed if the Customer has been unable to use Proxynode's service after 4 days, or if the service is not usable. Proxynode will assess whether the service can be considered usable.
3. You agree that the Customer may receive compensation if the Service cannot be used due to an error on the part of Proxynode, provided that this error is rectifiable. Proxynode reserves the right to determine an appropriate compensation itself.

Article 6 - Termination of service

1. Proxynode always provides the customer with the option to terminate the Service, unless stated otherwise.
2. You agree that if you terminate your Service, Proxynode has the right to delete all data.

Article 7 - Liability

1. You agree that the Customer is liable to settle necessary invoices for their Service.
2. You agree that Proxynode is not responsible for damages caused by intentional acts or equivalent conscious recklessness of its staff.
3. You agree that Proxynode is not liable for failed or non-functional backups.
4. You agree that if a complaint from the customer is deemed valid by Proxynode, Proxynode will, at its discretion, settle with the customer, provided that Proxynode's liability is always limited to the invoice amount of the respective items at most

Article 8 - Agreement

1. An agreement between Proxynode and the Customer exists after the Customer has made an initial payment to Proxynode.
2. You agree that Proxynode has the right to refuse orders or assignments without providing reasons
3. You agree that Proxynode has the right to cancel the Service at any time.
4. Upon entering into an agreement, the Customer declares themselves capable of acting in accordance with the law, being 18 years of age or older, or having consent from parents/guardians.

Article 9 - Prices

1. You agree that Proxynode is authorized to adjust prices of its Service(s) at any time. These changes will take effect for current products and Service(s) at the next billing cycle of specific Service(s).
2. In the event that Proxynode adjusts prices, these prices will immediately apply in the webshop

Article 10 - Unauthorized activities

1. You agree that it is not permitted to use your Service for Illegal activities.
2. You agree that Proxynode has the right to suspend your Service for inspection if we reasonably suspect that illegal activities are taking place on your service. Proxynode reserves the right to conduct such inspection to verify the presence of such activities.

Article 11 - Excessive usage

1. In the case of excessive and reckless usage of Proxynode's Service(s), Proxynode is entitled to either restrict the Service(s) or send an additional invoice for the excessively used portion of the Service, the price of which Proxynode may determine.
2. You agree that Proxynode has the right to immediately terminate your Service(s) in the >event of excessive usage.

Article 12 - Conditions

1. These Conditions are always in effect.
2. Proxynode is authorized to amend or fulfill its Conditions at any time, regardless of the situation.
